Legal Fees for Real Estate and Construction

  • Buyer Representation for Rental Properties With 1-3 Units

    Price: $2,000 flat fee

    Contracts: Review Offer and negotiate Purchase & Sale Agreement.

    Leases: Review leases and highlight relevant issues.

    Mortgage Loan: Review loan documents, compare to your Commitment Letter, make necessary revisions.

    Enforceability Opinion: If the Buyer is an LLC, lenders often require a legal opinion stating that the LLC has authority to buy the property and who has authority to sign on behalf of the LLC. I’ll take care of this.

    Member Vote & Manager Certificate: Lenders also require a written vote of the LLC’s Members and a certificate stating that the Manager has authority to sign for the LLC.

  • Seller Representation for Rental Properties With 1-3 Units

    Price: $1,200 flat fee

    Contracts: Review Offer and draft Purchase & Sale Agreement to send to the Buyer.

    Leases: Compile leases, advise of any potential issues, send to Buyer for review.

    Mortgage Payoff: Obtain a mortgage payoff statement from your lender for the closing.

    Member Vote & Manager Certificate: If you own the property under an LLC, I’ll draft the Member Vote and Manager Certificate to authorize the sale and provide to the closing attorney if requested.

  • Buyer and Seller Representation for Commercial Property Sales

    Price: $350/hour

    Applies To: Multifamily Properties with 4+ units, retail stores, mixed-use properties, development sites, and other commercial properties.

    Due Diligence: Compile relevant public records and review for zoning, environmental, title, and other potential issues.

    Leases: Review tenant leases and confirm landlord and tenants are in compliance.

    Contracts: Review Offer and negotiate Purchase and Sale Agreement.

    Zoning: Review permit records to confirm property is in compliance with zoning code.

  • Zoning Opinions for Proposed Developments & Commercial Properties

    Price: $350/hour (or fixed fee based on project)

    Applies To: Proposed new construction developments, renovation projects, existing commercial properties.

    Proposed Developments: If you’re thinking of buying a property to build on but don’t have plans yet, then I’ll start by sketching a site plan showing the footprint where the building can be built. Then I’ll create a spreadsheet to calculate the total number of units and living space that can be built, as well as the required number of parking spaces. If you’re interested, I can also create a rough 3D rendering of the proposed building situated among the neighboring properties. With this information, I’ll draft a memo explaining what you can build and what variances and special approvals you’ll need if you want to build more.

  • Standard Zoning Opinion for Existing Property

    Price: $600 flat fee

    Applies to: Properties with 1-3 units and some larger buildings if permit records and records showing current use are accessible and updated.

    Description: If you’re buying or refinancing an investment property, your lender might require a Zoning Opinion confirming that the use of the property and the dimensions of the building comply with the local zoning code.

    I’ll get the permit jacket from the local Building Department, a copy of a site plan, and the building’s dimensions from public records, then compare them to the requirements in the zoning code and write a memo explaining whether or not the property complies.

  • Construction Contract Template Package For Subcontractors

    Price: $2,000 flat fee

    Description: Package of contracts and forms that subcontractors can modify for each project. Designed to minimize subcontractor’s risk and streamline the process of executing contracts and processing payment requisitions.

    Proposal Form with appropriate legal terms to include when submitting your bids.

    Subcontract template for the contract between you and the general contractor.

    Sub-Subcontract template for contracts between you and your subcontractors.

    Lien Waiver Forms to submit with your payment requisitions to the general contractor, and to require from your lower-tier subcontractors.

  • Construction Contract Template Package for General Contractors

    Price: $2,000 - $5,000 flat fee depending on which documents are required and size of projects.

    Description: Package of contract templates and forms that General Contractors can modify for each project to minimize risk and streamline the process of executing contracts and processing payment requisitions.

    Owner Contract template for the contract between you and the property owner
